By now, you may have heard that there is federal legislation in Congress regarding RYO. Language to classify RYO retailers as “tobacco manufacturers” was included in the Senate Federal Highway Transportation bill. There are several things you should know about this legislation.
The legislative process in Congress can be cumbersome and slow. It can also be unpredictable. Our federal lobbying team is working hard to remove the RYO language, and attacking that on several fronts. We are hopeful that the House will not vote on the Senate bill before they adjourn on March 31st, which gives us additional time to have our voices heard. However, that is no reason to delay emailing your Member of Congress. Please go to http://www.house.gov/representatives/find/ and tell them that you oppose efforts to classify RYO retailers as “tobacco manufacturers” as it will put them out of business.

Madison - A Dane County judge has issued a temporary injunction blocking a state crackdown on roll-your-own cigarette machines.
Robert Petersen, owner of Rib Mountain Tobacco and Liquor, filed a lawsuit last year after the state Department of Revenue told machine owners they need manufacturing and distribution permits to operate. Petersen argues machine owners sell loose tobacco and leave the manufacturing to customers.
Judge Juan B. Colas issued a temporary restraining order blocking DOR's crackdown in October. On Friday, Colas granted Petersen's motion for a temporary injunction. The decision means the state crackdown remains stalled and signals the case will continue to a hearing on a permanent prohibition.
DOR spokeswoman Stephanie Marquis says agency officials are disappointed.

As some of you are aware, the Wisconsin Department of Revenue (DOR) has made a decision that the RYO Filling Station used in our store and many other stores across the country is, as of Friday, 9/23/11, illegal to operate. As store owners, we are relatively small in number. But with your help, we become a much louder voice. I am asking you to contact your Wisconsin Legislator, Senator, and the Governor to let them know how you feel about this decision. Your right of choice as an American has eroded over the years and apparently our “leaders” still think you need their help. Please take the time to phone, email, and/or write your representative and the Governor. Listed below are some points to put into your own words and some hints on how to find your Wisconsin representatives.
1. We do it ourselves. Still Smoking does not manufacture cigs. I, the customer, make them.
2. Quality of the product (I cough less, no chemicals, less addictive, I smoke less).
3. It creates jobs.
4. I still pay 71% tax on RYO tobacco.
5. My money is spent, and stays local. And the money I save is spent at other stores.
Not only are they shutting down the use of our machines, but the shutdown of those machines will cause over 75 businesses in the state of Wisconsin to close or move to another state including Illinois! That’s over 400 jobs! Tell them how you feel!
To determine your state representatives, go to www.legis.wisconsin.gov/ and click on the “Who represents me?” link. Put in your mailing address and it will tell you who and how to contact your senator and legislator.
